In consideration of Anderson’s Outdoor Adventures LLC rental services, The Anderson’s Outdoor Adventures LLC (hereafter referred to as AOA) premises and/or equipment to enable me to participate in kayaking, canoeing, paddle boarding, river tubing, pontoon boating, RV usage, golf cart usage, and shuttle services I agree as follows: 

1. Death or Injury can occur with any water sport activity.  

2. Life jackets are provided for each passenger with at least 1 whistle per vessel. If you do not wear them they do not work. (Children under 7 must wear them by law) 

3. Alcohol and water sports don’t mix. Paddle Responsibly 

4. You are responsible for all equipment in your possession. Loss or Damage or recovery will result in additional charges. Equipment is considered in your possession until you check-in with staff at service window with paddle(s) and vest(s)

5. You are responsible for the safety of all people who use your rental equipment. Especially Minor Children. 

6. If you have to be picked up at a location other than your pre-arranged last stop, a $100 per boat pickup fee will be charged.

*GINNIE SPRINGS IS OFF LIMITS - IF YOU STOP THERE AND ASKED TO BE PICKED UP A $150 PER BOAT CHARGE WILL BE ASSESSED in

ADDITION TO ANY APPLICABLE LATE FEES.

7. All rentals have a time in which they are to be returned. If you are late on returning your equipment, this will result in additional fees.

RENTALS MORE THAN 1 HOUR LATE WILL BE CONSIDERED YOU ARE LOST. THE PROPER AUTHORITIES WILL BE NOTIFIED. IN THE EVENT THAT AOA PROPERTY IS NOT RETURNED AOA WILL REPORT IT AS STOLEN

8. Wild animals are present and are not to be harassed or pestered in any way.  

9. You are responsible for abiding by the waterway rules while operating the equipment

10. Postponements, reschedules, and refunds are at the sole discretion of Anderson's Outdoor Adventures. Keep in mind that there are wild animals and this is an outdoor natural activity. We do not offer refunds for weather or the sighting of wild animals.

The person or persons signing this form, is taking sole responsibility for all activities done with or on AOA equipment and are also taking full responsibility for the safety or anyone aboard or using the rental equipment. Minors are required to be accompanied by an adult during these activities, and rentals. The person signing this form also agrees to have their license held for the rental until all equipment is checked-in and all fines, fees, and charges are paid in full.

By signing the form below I hold the above and below statements as true. Usage of AOA property is at their discretion, liability of such usage is solely on the signer(s) of this form. I do not hold AOA liable for any injuries to myself, others in my care, or my property. While I am using their facilities and/or property.

In consideration of Anderson’s Outdoor Adventures LLC rental services, The Anderson’s Outdoor Adventures LLC (hereafter referred to as AOA) premises and/or equipment to enable me to participate in kayaking, canoeing, paddle boarding, river tubing, pontoon boating, RV usage, golf cart usage, and shuttle services I agree as follows: 

I fully understand and acknowledge that: 

(a) outdoor recreational activities have inherent risks, dangers, and hazards and such exist in my use of paddle sport equipment and my participation in paddle sport activities. (B) my participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/ or total paralysis, death or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the owners, employees, officers or agents of AOA; the negligence of participants, the negligence of theirs, accidents, beaches or contract, the forces of nature or other causes. Risks and dangers may arise from foreseeable or unforeseeable causes including, but not limited to, guide decision making, including that a guide may misjudge terrain, weather, trail or river conditions, and water level, risk of falling out of or drowning while paddle sporting and such other risks, hazards and dangers that are integral to recreational activities that take place in a wilderness, river, outdoor, or recreational environment. 

By my participation in these activities and/ or use of equipment, I hereby assume all risks and dangers and all responsibility for any loses and/ or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, or employees of AOA, or by any other person including myself. I also verify that I am in good health, Not under the influence of any drugs or alcohol of any kind, nor do I have them in my possession , and am capable of pursuing paddle sports, and that my participation in this activity is voluntary. I/we also agree to a properly stowed or worn USCG approved personal floatation device, at all times. 

I, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, discharge, hold harmless, defend and indemnify AOA and its owners, officers, employees, lessors, contract mangers, Department of Environmental Protection, and the Board of Trustees, from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of paddle sport equipment or premises or my participation in paddle sport activities. I specifically understand that I am releasing, discharging, and waiving any claims or actions that I may have at present time or in the future for the negligent acts or other conduct by the owners, agents, officers or employees of AOA. 

I HAVE READ THE WAIVER AND RELEASE AND BY SIGNING IT, AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE AOA FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
